What is IRS Notice CP90?

IRS Notice CP90 is the final notice the IRS sends before beginning levy action to collect unpaid taxes. This notice:

  • Notifies you of the IRS's intent to levy your property or rights to property
  • Informs you of your right to a Collection Due Process (CDP) hearing
  • Gives you 30 days to request a hearing before levy action begins
  • Lists collection alternatives you may qualify for

CP90 is the final warning before the IRS begins seizing your assets. After 30 days, the IRS can levy your bank accounts, garnish your wages, and seize property without further notice.

💡 Note: CP90 vs. Modern Notices

CP90 is an older notice format. The IRS now typically uses Letter LT11 or Letter 1058 for final levy notices. However, CP90 may still be issued in certain cases and has the same legal effect.

How to Respond to CP90

Option 1: Request a CDP Hearing (Recommended)

File Form 12153 within 30 days of the notice date to request a Collection Due Process hearing. This automatically stops levy action while your case is reviewed.
